Often states will require a period of residency beforee allowing in
state tuition to prevent people from moving and immediately demanding
to pay in state tuition.

I'm puzzled as to what you think that the appellate process has to do
with anything. The issue is not whether such a case is legal precedent,
the issue is whether such a case has occurred at all.

If you are going to continue to harp on the appellate process and the
validity of cases as precedent, then quite frankly you've got something
wrong with you.
