liabilities.
I was involved in car accident in 2003. Another vehicle drove into mine
at a junction. We both denied liability, both myself and the driver of
the other car. My car insurance policy was fully comprehensive.
I chased my insurance company on many occasions, but the matter dragged
on and on. They said "there's nothing more we can do, the other
insurance company doesn't respond to our letters". They also said that,
apparently, that car insurance companies have three years to
reply/settle the claim.
Anyhow, eventually, the matter went quiet and I thought nothing more of
it.
However, I've now received a personal claim for damages from the driver
of the other vehicle for a huge sum of money. He's put my name as the
name of the defendant and not the name of my insurer. Surely, the claim
(if any) should be against them. That's what we pay our premiums
for??!!
What should I do? Can I ask the court to change the defendant to my
insurer? How could this happen? Is it legal?
I'm scared, I can't afford this amount of money.

I think the general procedure is just get in touch with your insurance
company, and forward any post to them, and let them do the worrying.
It's what they're there for!

No any claim is against you - but you get your insurance company to act on
your behalf - thats what you pay them for. | |
