If it was just three circles, I don't think Disney could stop it. They
could try, but unless it had Mickey's face on it, I don't think they
could get a copyright to hold on three plain circles. All you would
have to do is change the ratio between the large and the smaller
circles and I believe it would need a whole new copyright. That's sort
of what happened with the guy who came up with the yellow Happy Face
symbol in the early 70s. He couldn't get a copyright to stick. The
design was so simple, small variations could be made to his design
that the variation became a whole new animal. Sort of like knock off
Barbie dolls. Over the years we've all seen MANY 11" "fashion dolls on
the market that look sort of like Barbie, but aren't.
But actually, it wouldn't surprise me if Disney might actually allow
this type product to be made. About 10 years ago we were buying a
fountain for our garden. While the transaction was being rung up, I
was flipping through a supplier's catalogue they had on the counter.
And honestly, they had many solid concrete Disney garden statuary
items in the catalogue. And yeah, they were Disney licensed and nicely
done. Mickey, Donald, Pluto, etc. They had a Snow White, and of course
the dwarfs as well. I had to have the Snow White for our garden. We
ordered it and it and in a few weeks we had this three foot high
statue of Snow in our front garden. Needless to say the thing was
HEAV-VY! We love looking out the window and watching people from the
neighborhood walk by and stand on the sidewalk looking at the statue
in horror. <G> We'd even put a Santa hat on her at Christmas. Sad
ending to the story is that she was stolen one day while we were at
work.
So, yeah, I'm sure that if someone could convince Disney that there
was a demand for the Mickey pavers, they probably could get Disney to
let them manufacture it.
